Enecsys Privacy Policy

Enecsys Limited a company with its address at Harston Mill, Royston Rd Cambridge, CB22 7GG United Kingdom and its affiliates ("Enecsys" “us” or “our”) is committed to protecting your privacy and this Privacy Policy sets out our privacy practices. Please take the time to review this Privacy Policy carefully as it tells you (together with our website terms of use and any other terms referred to in it or agreed between Enecsys Ltd and you) how your personal information will be processed by us.

By using any Enecsys website, including but not limited to www.enecsys.com and all associated sites linked to www.enecsys.com by Enecsys, its subsidiaries and affiliates, including Enecsys websites around the world (collectively, the “Site”), excluding any Enecsys websites, terms of sale or services that contain their own terms of use and privacy policy, and/or otherwise accepting these terms and conditions, you unconditionally agree to be bound by this Privacy Policy. Enecsys may share and use your personal information consistent with this Privacy Policy, and combine it with other information for purposes of Enecsys’ products, services, content and advertising.

New functions, features, products and/or services offered by Enecsys through its Sites or otherwise and our commitment to protecting the privacy of your personal information, may result in periodic changes to this Privacy Policy. As a result, please remember to refer back to this Privacy Policy regularly to review any amendments. If we change our Privacy Policy we will post the changes on this page, and may place notices on other pages of a Site or let you know about changes in our communications to you.

What do we collect and use personal information for?

We need to collect and process personal information about you in order to:

• provide any monitoring service to you;
• collect data in relation to the performance of Enecsys products and/or products of third parties used in connection with Enecsys products;
• process queries submitted by you;
• customise the service we provide to you;
• administrate or otherwise carry out our obligations in relation to any agreement you have with us;
• verify your identity (for example, in the event you require information specific to your use of Enecsys products or where it is necessary for Enecsys to confirm that you have not changed residence);
• anticipate and resolve problems with any goods or services supplied to you;
• carry out market research, including depersonalised statistical analysis which we may disclose to third parties;
• enable us to comply with any legal requirements, in the detection and prevention of fraud and other crimes, and for the purpose of safeguarding national security;
• send you information about products, services or events;
• if you enter an Enecsys promotion or sweepstakes, for administering such programs; or
• enable the continuous improvement of our products and services.

This information may include, but is not limited to, any of the following:

• your name, address, a user name and, in connection with your password, answers to question(s) that only you would know;
• information that you provide by filling in forms on a Site. This includes information provided at the time of registering to use a Site, subscribing to our service, posting material or requesting further services. We may also ask you for information when you enter a competition or promotion sponsored by us, and when you report a problem with a Site;
• if you contact us, we may keep a record of that correspondence;
• we may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them;
• details of transactions you carry out through a Site and of the fulfilment of your orders;
• details of your visits to a Site including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access; or
• precise monitoring related data, including but not limited to your home energy consumption and location.

We may collect from or ask you for this information through a Site, or via one of our telephone operators, or we may collect this information through your e-mail or other communications with us. Certain information is collected automatically, as described later in this Privacy Policy. Although we do not make it compulsory to give us every item of information we ask for, the more information you volunteer (and the more accurate it is), the better we can tailor our services for you.

Certain Enecsys services are offered in conjunction with our business partners. In such cases, we may need to share your personal information with them in order to provide these services. For example we may share such information with providers of maintenance for and installation of certain Enecsys products in order to install and monitor the performance of the Enecsys products and provide maintenance thereof. Please note that certain services may be unavailable if you decline disclosing your personal information.

 

Log files/IP addresses

When you visit a Site, we automatically log your IP address (the unique address which identifies your computer on the internet) which is automatically recognised by our web server. We use IP addresses to help us administer the Site and to collect broad demographic information for aggregate use. We do not link IP addresses to personally identifiable information.

 

Non personal information

We may automatically collect non-personal information about you, including but not limited to, the type of internet browsers you use or the site from which you linked to a Site. You cannot be identified from this information and it is only used to assist us in providing an effective service on a Sites. So long as we do not combine your personal information with this non-personal information, we may collect, use, transfer and disclose such non-personal information for any purpose. We may from time to time supply the owners or operators of third party sites from which it is possible to link to a Site with information relating to the number of users linking to a Site from their sites. You cannot be identified from this information.

 

Cookies

We may obtain information about your general internet usage by using a cookie which is a file stored on your browser or the hard drive of your computer. Cookies contain information that is transferred to your computer's hard drive. They help us to improve our Sites and to deliver better and more personalised services and products.

__utma	This cookie is typically written to the browser upon the first visit to your site from that web browser. If the cookie has been deleted by the browser operator, and the browser subsequently visits your site, a new __utma cookie is written with a different unique ID. This cookie is used to determine unique visitors to your site and it is updated with each page view. Additionally, this cookie is provided with a unique ID that Google Analytics uses to ensure both the validity and accessibility of the cookie as an extra security measure.	2 years from set/update.
__utmb	This cookie is used to establish and continue a user session with your site. When a user views a page on your site, the Google Analytics code attempts to update this cookie. If it does not find the cookie, a new one is written and a new session is established. Each time a user visits a different page on your site, this cookie is updated to expire in 30 minutes, thus continuing a single session for as long as user activity continues within 30-minute intervals. This cookie expires when a user pauses on a page on your site for longer than 30 minutes. You can modify the default length of a user session with the _setSessionCookieTimeout()method.	30 minutes from set/update.
__utmc	This cookie is no longer used by the ga.js tracking code to determine session status. Historically, this cookie operated in conjunction with the__utmb cookie to determine whether or not to establish a new session for the user. For backwards compatibility purposes with sites still using the urchin.js tracking code, this cookie will continue to be written and will expire when the user exits the browser. However, if you are debugging your site tracking and you use the ga.js tracking code, you should not interpret the existence of this cookie in relation to a new or expired session.	Not set.
__utmz	This cookie stores the type of referral used by the visitor to reach your site, whether via a direct method, a referring link, a website search, or a campaign such as an ad or an email link. It is used to calculate search engine traffic, ad campaigns and page navigation within your own site. The cookie is updated with each page view to your site.	6 months from set/update.

 
 

The above are all Google Analytics cookies. Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.  Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.

However, if you select this setting you may be unable to access certain parts of our site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you log on to our site.

Staff from Enecsys, or from our agents, may contact you from time to time by using the contact means you have specified to us in order to get your views and comments on the service we provide to you. If at any time you do not wish us to contact you in this way, please contact us as set out below in “Contacting us”.

Disclosing your information to others

We will only disclose your personal information according to the rights we have under law. We may, if permissible under applicable law, disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006. We may disclose your personal information to a third party as part of a reorganisation or a sale of the assets of Enecsys.

We may disclose your personal information to third parties:

• In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
• If we or substantially all of our assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
• To Enecsys’ strategic partners under contract to maintain the confidentiality of such information for purposes of providing, marketing for or improving, providing or delivering Enecsys’ products, services or advertising.
• If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use of a Site or terms and conditions of supply and other agreements; or to protect the rights, property, or safety of Enecsys, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

Information about products and services

It is very important to us that we provide you with the highest level of service. In order to help us do this, from time to time we may like to send you, with your consent, details of products and services which we think may be of interest to you. In addition, from time to time, Enecsys may share the information you supply to us with selected third parties to enable them to send you, with your consent, information which may be of interest to you.

Security

The internet is not a secure medium. We have implemented appropriate technology and policies to help safeguard your privacy from unauthorised access and improper use and will continue to update these measures as new technology becomes available. We cannot however guarantee the security of the transmission of data to a Site; any transmission is at your risk. Where we have given you (or you have chosen) a password which enables you to access certain parts of a Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. The same shall apply to any security questions you have chosen for the purpose of accessing a Site.

Kids

If you are under the age of 13, please do not provide any personal information on a Site. Enecsys does not knowingly use, collect or disclose personal information from individuals under 13, and we will to take steps to delete such information, regardless of any other provision of this Privacy Policy except to the extent required due to legal processes as described above.

 

Transferring your personal information outside the European Economic Area

As part of the services offered to you, the information you provide to us, including that collected from the monitoring system, may be transferred to countries outside of the European Economic Area (“EEA”) that offer a sufficient level of protection. By way of example, this may happen if any of our servers are from time to time located in a country outside of the EEA or one of our service providers is located in a country outside of the EEA. These countries may not have similar data protection laws to the EEA. If we transfer your information outside of the EEA in this way, we will take steps to ensure that your privacy rights continue to be protected.

In addition, if you use our services while you are outside the EEA, your information may be transferred outside the EEA in order to provide you with those services.
